Case Summary

SCSJ is standing up against the family policing system on behalf of Sheryl Smith, a dedicated activist in the Durham community for nearly two decades. Known for her selflessness, Ms. Smith has opened her home to raise children in need. She currently cares for her adopted daughter and is a foster mother to her two granddaughters. SCSJ represents Ms. Smith on criminal charges stemming from her interactions with Durham County Department of Social Services (DSS).

Following a thorough pre-trial investigation, SCSJ secured dismissals of all charges.

Why it's Important

The family regulation system relies on the criminal legal system to justify the separation of families. Charging a parent with a crime can often be the basis for removing children or delaying family reunification.

The U.S. Constitution requires that parental rights be treated with the utmost respect. It does not permit the removal of children from their families without due process and robust consideration of the child's best interests. Parents seeking to keep their families together deserve support from all government agencies rather than fearing that their children will be removed simply for seeking help during times of stress and instability.
